A jury with cahoonas!

In a world where so many victimizers pass the buck for their behavior, I was surprised to see a jury conclude that this DWI driver committed murder, and did not cause "an accident".

'Bout time they charged a drunk driver, and found him guilty of exactly what he did.

It wasn't the bartender's fault, nor the waitress's, nor even the booze.... it was soley Mr. Heidgen's responsibility for his behavior.

And the jury got it right.

drunk drivers

i dont care who ya are.. who served ya how much ya drank or the company that made the dang stuff. its the fault of the person behind the wheel that decided to drink and drive. i hate to admit it but i was once arressted for drunk driving. it was 1987 july 10th in san diego. i went to court admitted what i did without a lawyer trying to get me a lesser sentence and took the punishment i deserved that was handed down to me by a court of law. and i will also say i never did it again..

Does this mean that any fool who gets a DWI is guilty of attempted murder? ... not defending anyones action just curious.. you get in the car ..you have been drinking ..if its murder if you do kill someone cause you were driving drunk .. then the very act of you getting in the car and driving drunk could be considered an attempt ..I know .. i get tired of devils advocate ..but yanno this site screams for it. I myself think the most stringent of man slaughter sentences in these cases is called for ..except maybe ...just maybe in the cases involving multiple convictions for DWI..

as for cold blooded murder

umm that description is reserved for people who plan a murder .. usually for profit .. or love and make a conscious choice to kill someone .. i dont think ,most drunk drivers get in a car and say .I have had 6 drinks .. i am running into a fucker and killing His ass. truly a closer description would be negligent homicide even than man slaughter ..let the abuse start,,, me and that due process thing and man i hate being on this side of this one ..

as for cold blooded murder

I think we know what ya mean, cLovis! However, it's like some of the other stupid acts that have been reported here, such as child abuse, where some say "Off with their heads". The courts are not going to behead them, but some feel that is what they deserve :) I agree with you that the murder charge for a planned murder for whatever gain (did you see the one where the guy murdered his whole family because his step-dad wasn't going to let him go to prom?) should remain on the books as is! The law has degrees of murder for a reason, but I sure hope he sets a precedence for a stiffer enforcement of the DUI laws. And I hope it starts with our teenagers BEFORE they kill someone! When I was a teen, we just had to dump the alcohol or give it to the cops and we were free to go. Made it tough to LEARN anything... here in Missouri, a 16-18 year old caught driving under the influence of anything is supposed to lose their license until they're 21. But we had one boy that had multiple incidents of being stopped for doing stupid things and it took him killing a little girl while driving under the influence of something inhaled from a can for him to lose his license and go to jail. If they had taken his license the first time, that little girl would still be alive. This takes me back to my political stance: we don't need MORE laws, we need to ENFORCE the ones we have.

..... prompted the jury to take this action, were all the warnings given to the drunk driver by on-coming traffic that he was going the wrong way. He was SO drunk, I don't know how he even managed to get into his truck.

..... a speeding/reckless sober driver? Wouldn't their actions qualify them to also be charged with murder? Vehicular homicide? Is there a difference?

.....one's drinkin' in a bar, the other is drinkin' in the "Gentlemens Club"...but they both suffer from alcohol induced halucinations. :-)
